Fianna Fáil spokesperson on Children Robert Troy TD has expressed concern after a prosecution against Giraffe Childcare was shot down because the judge ruled that Tusla – the Child and Family Agency – did not have retrospective powers to take such cases.
Deputy Troy commented, “Tusla is seeking a review of this decision and that is to be welcomed. However the judgement is alarming in that it appears to say that the Agency has no powers over what happened prior to January 1 this year.
“It does seem to have taken a long time for proceedings to be taken against Giraffe Childcare and questions have to be asked there. However, prosecutions often take time to put together and for them to be invalidated by a change of agency is deeply concerning.
“I will be raising this matter with Minister Reilly in the Dáil next week.”
